Employment Relations (Flexible Working) Act 2023 - what is changing?

From 6 April 2024 employees will have the right to request flexible working from day one of their employment. 

Key features of this change include:

  • Employees can now make two statutory flexible working requests within any 12-month period, rather than just one as it currently stands.
  • Employers will have two months (reduced from the current three months) to consider and respond to statutory flexible working requests. 
  • Employers must consult with employees on alternative options before declining a statutory flexible working request. 
  • Employees will no longer be required to explain the impact of their flexible working request or how it could be mitigated. 
  • The previous requirement of 26 weeks’ service for making a flexible working request will be removed.
